The lawsuit

The lawsuit was filed in 2019 by a Quebec consumer who alleged that Canada Dry published "false or misleading" information on its labelling and advertising material.

A court document further elaborates on the plaintiff's allegations, specifically the phrase "Made From Real Ginger."

"It gives the false impression that Canada Dry ginger ale contains a functional amount of ginger, […] when in reality the quantity of ginger extracting flavour contained in a can or bottle of Canada Dry ginger ale is negligible," the document says.

We reached out to Canada Dry but did not receive a comment at the time of publication. A statement by the plaintiff's legal representation, LPC Avocat Inc., says "Canada Dry completely denies any and all wrongdoing or liability."

So, how do get your $7.50?

To make a claim, enter your email address on the Canada Dry Settlement website by January 15, 2021 at 5 p.m. eastern.

If the settlement agreement is approved by the Superior Court of Quebec on March 16, those who signed up will receive an email with a short online claim form to fill out, explained class counsel Joey Zukran of LPC Avocat Inc.

No proof of purchase will be required, he said, but only those who signed up before January 15 will be eligible.
